This ("Policy") describes how Aaron's, LLC, its parent company, affiliates, subsidiaries, divisions, and franchisees (collectively "Aaron's," "we" "our" or "us"), collects, uses and shares your information when you lease or purchase our products or otherwise interact or use our products or services (collectively, “Services”). Aaron's takes the privacy of its customers and visitors to its websites very seriously. We understand that you may have questions about how we collect, use, and share your information. This Policy describes the type of information we collect, how we use and share that information, how we protect that information, your choices regarding that information, and how you can contact us with any questions.

Our website is intended solely for users in the United States and Canada. If you are located outside of the United States and Canada and are accessing our website, your personal information as described in this Policy will be processed and stored in the United States, and the laws in the United States may not be as protective of personal information as laws in your resident country. If you do not agree with the processing of your personal information in the United States, or you do not otherwise accept this Policy or the Terms of Use, please discontinue your use of the website.

1. How Do We Collect Personal Information

From you. We may collect personal information and other information that you provide when you become a customer (such as when you purchase or lease items from us), sign up for our newsletters, create an account, join Aaron’s Club or file a Club claim, interact with our chatbot, enroll in automatic payments, visit our social media pages, enter a promotion, apply for a lease or a line of credit with us or otherwise enter into a contractual arrangement, apply to a position posted on our Careers platform, or otherwise use our Services.

From devices you use when you interact with us online. This includes information collected through our Services and automatically from devices you use to connect to our Services. For more information about this, please see our “Cookies and Similar Technologies” section below.

From third parties and publicly available sources. This includes personal information we collect from other public sources, including, but not limited to websites that enable social sharing, social media sites, and websites from our service providers, vendors, our affiliates, or other individuals and businesses. If you provide Personal Information to us regarding others, we rely on you to obtain that other person's consent for disclosing their information to us and inform that other person about how we will use the information and our contact details for any queries.

From you in person. This includes personal information we collect through our Services, such as entering into a contractual arrangement with Aaron’s at physical store locations, submitting a lease application, or participating in an Aaron’s event.

2. The Types of Personal Information We May Collect From You

Depending on how you interact with us, we may collect the following information:

• Contact Information, such as your name, home address, work address, email address, telephone number, or other similar identifiers.
• Biographic and Demographic Information, such as date of birth, age, gender, and photo.
• Financial and Payment Information, such as credit card details, bank account number, financial information, and payment preferences.
• Account Information, such as a user name and password, profile details you choose to provide, and feedback and reviews you may leave our Services.
• Activity Information, such as information we collect when you access and interact with our Services, including browser or device model and settings, operating system, and unique identifiers, clickstream data, cookies and localStorage, browsing history, search history, web-based location, IP address, browser information, and any other Internet usage information our Services may automatically record when you visit. For more information about cookies and similar technologies, please refer to the “Cookies and Similar Technologies” section below.
• Inferences, such as inferences drawn from any of the personal information identified.
• Other Personal Information you provide, such as the content provided either in your in your communications with us, including interactions with us online, in-person, or on the phone.
• Sensitive Personal Information, such as Social Security Number or Social Insurance Number, driver’s license number, passport number, other government-issued identification number, and mobile device geolocation data (including your precise geolocation) collected with your consent for the purpose of locating an Aaron’s store near you.
• Professional Information, such as information about your job function and role, title, professional affiliations, employer, and employment history and any other information that may be obtained from third-party background checks and feedback.

3. How We Use Your Personal Information

We may use your information for the following reasons, depending on your relationship with us:

• To provide you the products and Services requested.
• To communicate with you, such as when we respond to your inquiries and send you communications, including our newsletter, regarding our products and Services, information about your lease application, use of our "click-to-chat" or equivalent functionality for customer service purposes, or promotions offered, such as sweepstakes, contests, special events, and other events. This may also include when we send you administrative e-mail notifications, such as security or support and maintenance advisories.
• To market and provide to you our products and Services, including determining your eligibility for future products and Services or when determining your approved lease amount.
• To obtain information about your credit history from consumer reporting agencies to process your lease application, market products and Services to you, service your account, and prevent fraud and illegal activity.
• To enable you to participate in surveys and other research efforts.
• To serve you targeted advertising or content.
• To provide, market, and develop our products and Services, including to maintain our websites, troubleshoot, provide customer and technical support, conduct data analysis, test and research, and better understand the interests of our customers and store and website visitors who use our Services and products.
• To conduct marketing research.
• To understand how you interact with our Services and personalize the product experience and content (including advertising and messaging campaigns).
• To maintain the safety, security, and integrity of our Services, for example, by authenticating users and providing account security and fraud detection. We may also use your information to monitor, detect, and prevent fraud and improper or illegal activity.
• To debug our systems, to secure our online services, including our network and websites, and to debug our online services.
• To send you news and/or marketing communications (by email, phone, or text) subject to your marketing preferences and choices, including information about us or third-party offerings we think may be of interest to you.
• To conduct market research and develop quality assurance, including to study, develop, and improve our products and Services. This may include measuring and analyzing audience traffic, including tracking user interests, trends, and patterns. We may also aggregate, anonymize, and/or de-identify personal information we collect and use it for any purpose, including product development and improvement activities.
• To comply with legal requirements and/or to investigate or address claims or disputes relating to your use of the Services. This would include the use of your information to comply with our legal and regulatory obligations, to defend ourselves in litigation and investigations, and to prosecute litigations.
• To enforce contractual and payment obligations.
• To help recognize you as a previous visitor and save and remember your preferences and settings and deliver to you appropriate interest-based content.
• To conduct internal business purposes, including for data analysis, audits, and enhancing our Services. We may also use inferences drawn from personal information to create a profile reflecting your preferences, so we can tailor our Services to you.
• To collect analytics in order to understand how our products and Services are used and to improve them over time.
• To process and complete transactions, including collecting payment and contact information to process your transactions and deliver our products and Services to you.

4. How We Disclose Personal Information

We may disclose some or all of the personal information collected from or about you with any of the following entities and for any of the following purposes:

• Advertising or Marketing Partners. We may provide personal information to third parties, such as advertising partners or other marketing partners who provide services to us.
• Service Providers. We may provide personal information to vendors, payment processors, contractors, credit bureaus, debt collectors or the like, business and service partners who provide services to us, including analysis firms, vendors or business partners who may provide promotional materials to you about goods (including special offers and promotions), and others.
• Government, regulatory, or law enforcement agencies. We reserve the right to disclose your information to respond to valid information requests from government authorities and judicial requests, to investigate potential fraud, or where otherwise required by law. We may disclose your personal information where we believe the disclosure is necessary or appropriate to comply with regulatory or legal requirements, or to protect the safety, rights, or property of ourselves and others and to exercise, establish, or defend our legal rights.
• In connection with a merger, acquisition, or business transfer. If we sell all or a part of our company, are part of a merger, consolidation, restructuring, sale of company stock, and/or sale of assets or other corporate change, your information may be transferred as part of that transaction.
• At your direction. We may disclose your personal information at your direction or with your consent.
• Affiliates, Subsidiaries, Divisions, and Franchisees. We may disclose your personal information to our affiliates, subsidiaries, other related divisions, and franchisees in order to provide our products and Services.
• Collaborators. We may disclose personal information with collaborators with whom we jointly develop or promote our Services, including special offers, sponsorships and co-branded opportunities, Aaron’s Club facilitators, and promotions.
• The General Public. We may disclose personal information with the general public if you choose to disclose personal information when contributing content to our Services through posting reviews about our products, forums, blogs, social features, or the like.
• Aggregate Data. We may disclose your personal information in an aggregated or non-identifying form or otherwise in a form that cannot reasonably be used to identify you.

5. Children's Privacy

You must be 18 years or older to use our Services. Our Services are for a general audience, are not targeted to children, and do not knowingly collect personal information from children under 18 years of age.

6. Links to Third Party Websites

We may provide links to websites and other third-party content (e.g., social media platforms) that are not owned or operated by us. The websites and third-party content to which we link may have separate privacy notices or policies. We are not responsible for the privacy practices of these websites.

If you provide any personal information through a third-party site, your interaction and your personal information will be collected by and controlled by the privacy policy of that third party site. We recommend that you familiarize yourself with the privacy policies and practices of any such third parties, which are not governed by this Policy.

7. CCTV

We use CCTV video recording to protect the physical security of our property and Services in line with applicable laws. We do this to comply with our contractual obligations (e.g., with customers and insurers) and our internal physical security policies to safeguard our properties, workplaces, people and data.

8. Your Advertising Choices

When you use our Services, our third-party advertising partners, social media providers, and analytics providers may collect personal information about your online activity on our Services and on third party websites.

These providers may set web tracking tools (e.g., cookies and web beacons, as discussed further below) to collect information regarding your online activity. In addition, our advertising partners may use this information to deliver advertisements to you when you visit third party websites within their networks. If you would like more information about this practice, and to know your choices with respect to it, please either visit the Digital Advertising Alliance’s opt-out page (currently available at http://www.aboutads.info/choices/) or the Network Advertising Initiative’s opt-out page (currently available at http://www.networkadvertising.org/choices/). Please note that you may continue to receive generic ads that are not based on your preferences.

9. Information Security

We use commercially reasonable administrative, technical, personnel, and physical measures designed to safeguard information in its possession against loss, theft, unauthorized use, disclosure, or modification. However, the confidentiality of information transmitted over the Internet cannot be guaranteed. We urge you to exercise caution when transmitting personal information over the internet. WE CANNOT GUARANTEE THAT UNAUTHORIZED THIRD PARTIES WILL NOT GAIN ACCESS TO YOUR INFORMATION; THEREFORE, WHEN SUBMITTING PERSONAL INFORMATION TO US, YOU DO SO AT YOUR OWN RISK.

10. Cookies and Similar Technology

We and our partners use various tools to collect data when you visit our sites and apps, including cookies, pixels, localStorage, and other similar technologies. Some of these technologies store data in the browser or on your device. Other technologies may use network-related or other information to recognize your device (e.g., IP address). Our Services use these technologies, for example, when you first request a web page and data is then stored on your computer or other device so the website or mobile application can access personal information when you make subsequent requests for pages from that Service. These technologies may also be used to collect and store information about your usage of the Services, such as pages you have visited, other content you viewed, and search history. Additionally, we may use these technologies to collect analytics and measure the use of our Services.

We and our partners may also use these technologies to gather personal information about how you view and use our Services and content and to connect your activity with other data we store about you. We and our partners may collect your personally identifiable information about your online activities over time and across different websites when you use the Services. The use of these technologies helps us serve you better by understanding what you are interested in, tracking trends, measuring the effectiveness of ads, saving your preferences, and storing information you may want to retrieve on a regular basis. We also allow specific, approved partners to collect data from your browser or device for advertising and measurement purposes using their own similar tools.

Your web browser can be set to allow you to control these technologies, such as whether you will accept cookies, reject cookies, or to notify you each time a cookie is sent to your browser. If your browser is set to reject cookies, websites that are cookie-enabled will not recognize you when you return to the website, and some website functionality may be lost. Depending on the make and model of your phone, you may be able to use device settings to opt out of the use of certain device IDs for targeted advertising. Some browsers permit the user to send a “Do Not Track” (“DNT”) preference to websites that the user visits indicating that the user does not wish to be tracked over time and across websites. Because there is not yet a common understanding of how to interpret DNT, we do not currently respond to the DNT signal on our websites. We do, however, respond to the global privacy preferences when required by law.

11. Your Marketing Preferences

We may periodically send promotional materials or notifications related to our Services. If you no longer wish to receive promotional marketing materials from us, you may opt out of receiving such materials. You may unsubscribe from receiving marketing or other commercial emails from us by following the instructions included in the email.

You may unsubscribe from text messages you previously consented to by following the prompt provided on our messages. We will work to comply with your request promptly.

There are certain service notifications and other non-promotional emails that you may not opt out of, such as notifications of changes to our Services or policies or information about your order, such as shipping information.

12. Additional Information for Consumers of California and Other U.S. States with Similar Privacy Laws

Consumers of certain U.S. states may have additional rights regarding their personal information. This Section provides information for consumers in California and other states with similar privacy laws (“Relevant Laws”). Under these Relevant Laws, “Personal Data” and/or “Personal Information” generally means information that identifies, relates to, or describes a particular consumer in California or other state with a similar privacy law. For purposes of this Section, “Personal Information” is synonymous with “Personal Data”.

Some states define “sale” as the exchange of information for monetary consideration, while other states define “sale” as providing your information in exchange for valuable consideration, which may or may not be monetary. We do not “sell” Personal Information, as defined under California and other similar state privacy laws. However, we do engage in targeted advertising, which helps to serve you with Aaron’s ads when you are not on our site. Note that the definition of “sale” under Colorado and Connecticut laws is different, and targeted advertising could be considered “selling” under Colorado and Connecticut laws or “sharing” under California law.

In addition, we may process each category of Personal Information in order to protect Aaron’s and others’ rights, and/or to complete a merger, bankruptcy, sale of assets, or other corporate transaction, which is not included in the definition of “sale” under California or other similar state privacy laws. Please see the “Use and Disclosure” section above for more details about our purposes for processing, including how other parties may process Personal Information.

This Section provides details about the categories of Personal Information of consumers in California and other states with similar privacy laws that we have collected, disclosed, “shared”, “sold”, or processed for purposes of targeted advertising, as well as rights consumers have under Relevant Laws. Based on your interactions with us, we may not have collected, disclosed, “shared”, “sold”, or processed for purposes of targeted advertising each (or any) of these categories of Personal Information for each listed purpose.

Categories of Personal Information Collected, Disclosed, “Shared,” “Sold,” or Processed for Targeted Advertising

The chart below indicates the categories of Personal Information that we have collected, disclosed, “shared” (under California law), processed for purposes of targeted advertising (e.g., under Texas law), or “sold” (e.g., under California, Colorado, and Connecticut laws); the purposes for processing; and the categories of third parties to whom each category of Personal Information was disclosed, “shared”, “sold”, or processed for targeted advertising purposes. Please note that we process Personal Information in connection with certain types of advertisements, which could be considered “sharing” under California law or “selling” under other state privacy laws (e.g., California, Colorado, and Connecticut). Additionally, we do not knowingly “share”, “sell”, or process Personal Information of minors under 16 years of age.

Sensitive Personal Information. We do not process “sensitive” Personal Information for purposes other than as permitted by law (such as to provide you with the product or Services you requested or to prevent, detect, and respond to security incidents).

Data Retention. We will retain Personal Information from or about you as reasonably necessary and proportionate to achieve the purpose(s) for which the Personal Information was collected or processed as outlined in this Section, unless a longer retention period is required or allowed by law.

Purposes

We may use Personal Information and/or disclose it to third parties for the following purposes:

• to provide our products and Services;
• to accomplish our business purposes and objectives, including:

• developing, improving, repairing, and maintaining our products and Services;
• personalizing, advertising, and marketing our products and Services;
• conducting risk and security controls and monitoring;
• detecting and preventing fraud, and other prohibited or illegal activity;
• maintaining our facilities and infrastructure;
• performing accounting, audit, and other internal functions;
• complying with the law, legal process, and internal policies;
• conducting research, analytics, and data analysis;
• quality and safety assurance measures;
• performing identity verification; and

• to operate, manage, and maintain our business, including but not limited to, corporate transactions, such as a sale, acquisition, reorganization, merger, or transfer of all or a part of our business, bankruptcy, or similar proceedings.

Sources of Personal Information

We collect this Personal Information directly from consumers who reside in California and other states with similar privacy laws, as well as from social media platforms; referrals; joint marketing, co-branding, co-promotional, or advertising partners; and sources of demographic and other information, including through devices you used to interact with us through our Services, consumer data resellers, and publicly available information. All sources of Personal Information collected are noted in the “How Do We Collect Personal Information” and “The Types of Personal Information We May Collect From You” sections above. Based on the individual’s interactions with us, we may not have collected Personal Information from each (or any) of these sources.

Consumer Rights Under California and other Similar State Privacy Laws

If you are a consumer who resides in California or other state with a similar privacy law, you may have the following rights, as described below.

We are required by law to verify your identity depending on the type of request in order to prevent unauthorized access of your data. Failure to verify your identity may result in your request not being processed. Where required by applicable law, we will notify you if we deny your request and the reasons we are unable to honor your request.

To Exercise Rights

In order to exercise your Right to Opt Out of Targeted Advertising or the “Sale”, “Sharing” of your Personal Information, please visit our "[Do Not Sell or Share My Personal Information and Targeted Advertising Opt Out]" page.

Depending on your state of residence, in order to exercise your Right to Appeal our action in response to your request, please email us using the email address in the “Contact Us” section below.

In order to exercise your other rights described above, please call us at 1-800-950-7368 or submit a request through the linked form at privacy.aarons.com. Additionally, we may need to obtain information about you or your specific request in order to verify your identity and respond.

Authorized Agent

Depending on your state of residence, you may have the right to submit a request through an authorized agent. If you are an authorized agent acting on behalf of a consumer residing in California or another state with a similar privacy law, you must be able to demonstrate that you have the requisite authorization to act on behalf of the consumer.

Automated Processing/Profiling

In order to provide our products and Services, we use certain types of automated processing in furtherance of our underwriting program. This type of processing may constitute “profiling” (“Profiling”) under some privacy laws, which means we use a form of automated processing to analyze your personal information in order to make decisions related to applications for a lease.

Our Profiling system is essential to the provision of our products and Services. However, if you would like your application reviewed without the use of Profiling, you may complete your lease application in person at an Aaron’s store near you. You can find a nearby Aaron’s retail location at https://locations.aarons.com/.

Please note that Profiling provides benefits to our customers by offering a smoother and quicker underwriting process. If you choose to have your application reviewed without the use of Profiling, your application may be delayed.

13. Additional Information for Canadians

Your rights under Canadian privacy legislation. If you are from Canada, you may have the following rights with respect to personal information. Note that we are required by law to verify your identity in connection with any request in order to prevent unauthorized access of your data. Failure to verify your identity may result in your request not being processed. Where required by applicable law, we will notify you if we deny your request and notify you of the reasons we are unable to honor your request.

Additionally, we may need to obtain information about you or your specific request in order to verify your identity and respond. Data Retention. We will retain personal information from or about you as reasonably necessary and proportionate to achieve the purpose(s) for which the Personal Information was collected or processed as outlined in this Policy unless a longer retention period is required or allowed by law.

14. International Data Transfers

We are based in the United States. Any information you provide to us through use of the Services may be stored and processed, transferred between, and accessed from the United States and other countries which may not guarantee the same level of protection of personal information as the one in which you reside. We may need to send your personal information overseas as part of our normal business operations. Provided the data protection laws of these other countries differ from those in the United States, please be assured that we take reasonable steps to ensure that your privacy is protected.

15. Updates to the Policy

We may update this policy from time to time. To the extent permitted by law, any changes to this Policy will be posted to the websites and will become effective upon posting. Any changes will be effective only after the effective date of the change and will not affect any dispute arising prior to the effective date of the change.
